These Terms govern your access to and use of the Aeroride platform, products, and services (the "Platform"), provided by AeroRide Inc., a Delaware Corporation, 1401 Pennsylvania Ave. STE 105, Wilmington, Delaware 19806, United States — support and legal contact: info@aeroride.app. By accessing or using the Platform you agree to be bound by these Terms.
Aeroride operates an online marketplace connecting Users with independent, certified aircraft Operators. Aeroride is solely an intermediary and facilitator — it does not own, operate, provide, control, or act as a carrier for any aircraft or air transportation service.
The Operator named on your booking confirmation is the party providing the transportation, and is responsible for the operation and safety of the flight, crew conduct, regulatory compliance, and any claims arising from carriage of passengers and baggage.
Aeroride requires Operators to maintain valid certificates, licenses, and insurance (e.g., FAA Part 135 or the equivalent Air Operator Certificate) as a condition of listing, and may verify or suspend listings, but does not perform ongoing operational oversight beyond document verification.
Through the Platform you may search, request, quote, and book private charter flights offered by certified Operators, selecting airports, dates, passenger count, and aircraft category.
A quote includes the Operator’s flight cost, applicable taxes, and Aeroride’s Service Fee. A booking is not final until the Operator accepts and Aeroride issues a formal Booking Confirmation email — until then, your request is a non-binding offer.
The Booking Confirmation is the legally binding contract for air transportation, and includes the Operator’s name, aircraft type/tail number (where available), airports, schedule, and Total Price. Required travel documents and payment verification must be submitted before a booking is finalized.
Valid government-issued identification (passport for international flights) matching your booking details is required; failure to present it may result in denial of boarding without refund.
Passenger substitutions may be requested by email up to two (2) hours before scheduled departure, subject to Operator approval; no changes are accepted after that.
All passengers must be medically fit to fly; pregnant passengers or those needing special assistance must notify Aeroride at least 48 hours in advance. Weight, luggage, pets, customs/immigration compliance, and prohibited items are all subject to Operator policy, and the Operator may deny boarding at its sole discretion for non-compliance, with no compensation due.
Prices are for chartering the entire aircraft, split among your travel party up to seat capacity, and can change until a booking is confirmed and paid. All payments are processed electronically through Aeroride’s secure payment system — no cash, bank deposits, or offline payments are accepted.
The Total Price typically includes the Operator’s flight charges, airport fees and taxes, government duties, ground-handling costs, and Aeroride’s Service Fee. Charges not included upfront (customs/immigration fees, de-icing/special handling, catering, overweight/route-change fees) are billed separately and are your responsibility.
You must report any discrepancy in your Booking Confirmation within 12 hours of receipt. Aeroride may correct obvious pricing errors by honoring the corrected rate or cancelling with a full refund.
You may cancel a confirmed booking in writing to info@aeroride.app. Cancellations at least 48 hours before departure are eligible for a 50% refund of the Total Price; cancellations within 48 hours of departure are non-refundable.
If you or a passenger fail to appear within 20 minutes of scheduled departure, the booking is a no-show and no refund or credit is issued.
If the Operator cancels for operational reasons unrelated to weather/airspace restrictions, Aeroride will try to arrange a replacement aircraft/Operator under similar terms; if none is available, you receive a full refund. Approved refunds are issued to the original payment method and may take 7–14 business days. Aeroride’s Service Fee and third-party processing charges are non-refundable except where the cancellation is Aeroride’s error.
Flight schedules are not guaranteed. Delays or cancellations due to weather, air traffic control, airport closures, or other Force Majeure Events are not eligible for refund, though the Operator may offer to reschedule at the earliest safe opportunity. Aeroride is not liable for consequential losses from such events.
If a delay is directly caused by the Operator’s fault (mechanical issues, crew unavailability, scheduling mismanagement), the Operator is responsible for compensation — recommended at up to 5% of the Total Price per hour of delay, capped at 20% of the booking value, unless law or agreement provides otherwise.
Flight status, delays, and diversions are communicated through the Aeroride App, including real-time tracking from departure to arrival; the accuracy of this information depends on the Operator and airport authorities, and Aeroride is not liable for delays or errors outside its control.
Aeroride is a marketplace, not an air carrier, operator, or travel agency. Your transportation contract is with the Operator, and Aeroride is not liable for the operation of the aircraft, flight safety or maintenance, delays/cancellations, baggage, or airport/ATC issues — except for direct damages caused by Aeroride’s own gross negligence or willful misconduct (e.g., payment-processing errors), and never for indirect, incidental, or consequential damages.
Operators must maintain liability insurance covering passengers, aircraft operations, and third-party damages per their jurisdiction’s requirements; Aeroride does not guarantee that such coverage is active, sufficient, or up to date, and strongly recommends Users purchase their own travel/trip insurance.
By using the Platform you acknowledge the inherent risks of private charter flight and agree to hold Aeroride harmless from claims arising from the Operator’s operational or flight-related acts.
You agree to indemnify, defend, and hold harmless Aeroride and its affiliates, directors, officers, employees, and agents from claims arising from your breach of these Terms, inaccurate information you provide, misuse of the Platform or payment methods, violations of law or third-party rights, or your own misconduct or negligence.
The Operator is a separate legal entity and may seek damages directly from you (e.g., for aircraft/property damage or safety-rule violations), and you may likewise bring claims directly against the Operator for failure to provide the contracted flight service.
The Aeroride name, app, website, and all related content are owned by Aeroride or its licensors; you receive only a limited, non-exclusive, revocable license to use the Platform to book flights.
You may not scrape or harvest Platform data, use fraudulent payment methods, attempt unauthorized access to accounts or Operator systems, resell flights without authorization, or otherwise violate applicable law — doing so may result in account suspension, termination, and legal action.
Aeroride may suspend or terminate your account at its sole discretion, with or without notice, for reasons including breach of these Terms, fraud, repeated no-shows/cancellations, false information, or conduct harmful to the Platform, Operators, or other Users. Pending bookings may be cancelled and prepaid amounts forfeited subject to the refund policy above.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes are first addressed through good-faith negotiation, and if unresolved within 30 days, are settled exclusively by binding arbitration administered in Delaware.
For claims originating in Costa Rica, Aeroride may coordinate local administrative/procedural assistance through a designated partner, but the arbitration itself remains governed by U.S. law. You waive the right to participate in class actions; each party generally bears its own costs.
Direct inquiries first to info@aeroride.app; unresolved complaints may be escalated to Aeroride’s Legal Department at the same address. U.S. Users may also contact the Department of Transportation (DOT); Costa Rican Users may contact the applicable Consumer Protection Authority or GDAC. Aeroride acknowledges complaints within 3 business days.
Aeroride may update these Terms at any time. Material changes are communicated at least 30 days in advance via email or a prominent Platform notice; continued use after the effective date constitutes acceptance. Before completing payment, you will always be shown clear links to the current Terms of Use and Privacy Policy and asked for explicit consent.
